Marketplace Creator Terms

These Marketplace Creator Terms ("Marketplace Terms") govern publishing to and using the Wonder Marketplace (the "Marketplace"). They supplement, and are part of, our Terms of Service; the Privacy Policy also applies. Where these Marketplace Terms conflict with the Terms of Service on a Marketplace-specific matter, these Marketplace Terms control. Capitalized terms not defined here have the meaning given in the Terms of Service.
We are Aquila Labs, Inc., doing business as Wonder ("Company," "we," "us," "our"), a company registered in Delaware, United States at 131 Continental Dr Suite 305, Newark, DE 19713. You can contact us at team@wonder.so.
1. What the Marketplace is
The Marketplace is a place where users ("Creators") publish design files and, over time, other shareable artifacts they make with Wonder (each, together with its metadata, preview image, and description, a "Listing") so that other users ("Users") can discover them, view them, and — where the Creator allows it — reference, remix, or download them. Each Listing links back to the underlying file in the Wonder app.
2. Eligibility
To publish a Listing you must have an account in good standing and meet the eligibility requirements in the Terms of Service. You are responsible for all activity under your account, including everything you publish.
3. Your content, your responsibility
You retain whatever ownership rights you have in the content you publish. Wonder does not claim ownership of that content. The ownership and other limitations applicable to AI-generated Output are described in the Terms of Service. You are solely responsible for your Listings, including the underlying file, its preview image, and all metadata (title, description, categories, tags).
By publishing a Listing, you represent and warrant that:
- You own the content or have all rights, licenses, and permissions necessary to publish it and to grant the licenses in these Marketplace Terms.
- The content does not infringe or misappropriate anyone's intellectual property, privacy, publicity, or other rights, and does not violate any law or our Community Guidelines.
- The preview image and description accurately represent the underlying file. Deceptive previews are prohibited.
- Any third-party materials in the content (fonts, images, icons, trademarks, code) are ones you are licensed to include and to sublicense on the terms you select for the Listing.
You must not publish content you do not have the right to share. If you are unsure whether you hold the necessary rights, do not publish it.
4. License you grant to Wonder
Publishing a Listing is an act of sharing under Section 5.3(b) of the Terms of Service, so the publishing license in that Section applies to each Listing, including its underlying file, preview, and metadata. For clarity, you grant Aquila Labs, Inc. a non-exclusive, transferable, worldwide, fully paid, royalty-free, and sublicensable license, through multiple tiers of sublicensees, to use, host, store, cache, copy, reproduce, index, process, modify, adapt, translate, create derivative works from, generate previews and thumbnails from, transmit, distribute, publicly perform, publicly display, commercialize, and derive revenue or other remuneration from your Listing, in whole or in part, for the purposes of operating, providing, and promoting the Services. This includes using and distributing the Listing:
- through the Marketplace and the Wonder app; and
- in a reasonable manner to market and promote the Marketplace (for example, showing your preview image and title in a category page, feed, sitemap, social card, or announcement).
To the extent permitted by law, you waive and agree not to assert moral rights or similar rights that would prevent Wonder or its sublicensees from exercising this license.
This license applies for as long as the Listing is published. When you remove a Listing, or we do, the license ends, except that it survives to the extent needed to serve copies already distributed or cached until they refresh, to honor a license another User already relied on under Section 5, to keep routine backups, and to exercise rights that accrued while the Listing was live. Removing a Listing does not require Wonder to recall copies already distributed, cached, downloaded, remixed, or stored by Wonder or others. This license does not transfer ownership of your content to Wonder or limit privacy, deletion, or other data-protection rights that cannot lawfully be waived.
5. License you grant to other Users
Each Listing carries a license that you choose, shown on the Listing:
- CC BY 4.0 — preselected in the publishing flow. Users may use, adapt, and build on the content, including commercially, provided they give appropriate attribution, under the Creative Commons Attribution 4.0 International license.
- All rights reserved — no license is granted to Users beyond viewing the Listing on the Marketplace; Users may not reuse the content without your separate permission.
Check the license shown on the Listing before you publish. Every published Listing can be viewed on the Marketplace. Independently of the license, each Listing also carries permission settings that control whether Users may remix it into their own workspace and whether they may download it. These permission settings describe what the Marketplace enables; they do not enlarge the underlying license. You are responsible for choosing a license and permissions consistent with the rights you actually hold. Once other Users have relied on a granted license (for example, remixed a CC BY 4.0 file), that grant continues for the copies they made even if you later change the Listing's license or remove it.
6. Our role and rights
We provide the Marketplace as a hosting and discovery service. We do not pre-screen every Listing, and we are not the author or publisher of Creator content.
We may, at our discretion and without obligation:
- review a Listing before or after it goes live, and hold new Listings in a pending state pending review;
- fast-track publishing for trusted Creators or organizations;
- reclassify, re-categorize, or edit metadata for accuracy;
- withhold, unpublish, delist, or remove any Listing, or limit its distribution, if we believe it violates these Marketplace Terms, the Terms of Service, the Community Guidelines, or the law, or to comply with a valid legal request;
- respond to reports and takedown notices as described in our Copyright Policy.
We have no obligation to publish, keep published, or promote any Listing.
7. Prohibited content and conduct
You must not publish content that violates our Community Guidelines or the Copyright Policy. This includes, without limitation, infringing or stolen work, impersonation, deceptive previews, spam, malware, and content that is unlawful, harmful, or violates others' rights.
8. Fees
Publishing to and browsing the Marketplace is currently free. We may introduce paid features, paid Listings, or Creator payouts in the future; if we do, we will publish separate terms governing them before they apply to you, and those terms will control for those features.
9. Suspension, termination, and repeat infringers
We may suspend or terminate your ability to publish, or remove your Listings, if you breach these Marketplace Terms, the Terms of Service, or the Community Guidelines. Consistent with our Copyright Policy, we terminate the accounts of repeat infringers in appropriate circumstances. You may remove your own Listings at any time; removal is subject to Section 4.
10. Disclaimers and liability
The Marketplace and all Listings are provided "as is" and "as available." Content is created by Creators, not by us, and we make no warranty about any Listing's accuracy, quality, ownership, licensing, or fitness for a purpose. You are responsible for evaluating a Listing and confirming your right to use it before you rely on it. To the maximum extent permitted by law, the disclaimers and limitations of liability in the Terms of Service apply to the Marketplace and these Marketplace Terms.
11. Changes to these terms
We may update these Marketplace Terms from time to time. We will post the revised terms and change the "Last updated" date above. For a material change affecting existing account holders, we will provide notice by email, an in-product message, or another reasonable method at least 30 days before the change takes effect unless a shorter period is necessary for law, security, fraud prevention, or an urgent feature change. Non-material changes may take effect when posted, and changes may take effect immediately for people who first use the Marketplace after the update. We may ask you to affirmatively accept a material update.
If you do not agree to an update, you must stop using the Marketplace and remove any Listings before the update takes effect. A Listing license granted before removal survives as described in Section 4.
